Welcome to Mivro. These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and services (collectively, the "Services"). By using Mivro, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

By creating an account, accessing, or using any part of Mivro, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users, including browsers, registered users, and contributors.

2. Eligibility

You must be at least 13 years of age to use our Services. By using Mivro, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or guardian to use the Services.

3. Account Registration and Security

• Account Creation: You must provide accurate, current, and complete information during registration.
• Account Security: You are responsible for maintaining the confidentiality of your password and account credentials. You agree to notify us immediately of any unauthorized access or security breach.
• Account Responsibility: You are solely responsible for all activities that occur under your account.
• One Account Per User: Each user may maintain only one account.

4. Use of Services

4.1 Permitted Use

Mivro provides tools for scanning product barcodes, analyzing nutritional content, receiving personalized health recommendations, chatting with AI assistants, and discovering healthier product alternatives.

4.2 Prohibited Activities

You agree NOT to:

• Use the Services for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to our systems, servers, or databases
• Interfere with or disrupt the integrity or performance of the Services
• Use automated tools (bots, scrapers) to access the Services without permission
• Reverse engineer, decompile, or disassemble any part of the Services
• Upload malicious code, viruses, or harmful content
• Impersonate another person or entity
• Share or distribute your account credentials with others
• Use the Services to harass, abuse, or harm others
• Violate any applicable laws or regulations

5. Content and Health Information

5.1 Information Accuracy

Mivro retrieves product information from third-party sources (primarily OpenFoodFacts). While we strive to provide accurate information, we do not guarantee the completeness, accuracy, or reliability of product data. Always verify critical information directly on product packaging.

5.2 Health Recommendations

The health recommendations, nutritional analysis, and AI-generated suggestions provided by Mivro are for informational purposes only and DO NOT constitute medical advice, diagnosis, or treatment. Always consult with qualified healthcare professionals before making health-related decisions.

5.3 Allergen Information

While our Services can identify potential allergens based on your profile, we cannot guarantee complete accuracy. Always read product labels carefully and consult with medical professionals regarding allergen safety.

5.4 User-Generated Content

You retain ownership of content you submit (chat messages, images). By submitting content, you grant us a non-exclusive, worldwide license to use it solely for providing and improving our Services.

6. AI Services

Our Services use Google Gemini AI for nutrient analysis, recipe generation, and product recommendations. AI-generated responses may occasionally be inaccurate or incomplete. We are not responsible for errors in AI-generated content.

7. Intellectual Property

7.1 Open Source

Mivro is an open-source project. Our source code is available under the license specified in our GitHub repository. You may use, modify, and distribute the code in accordance with that license.

7.2 Trademarks

"Mivro" and associated logos are trademarks of 1MindLabs. You may not use our trademarks without prior written permission except as allowed by our open-source license.

7.3 Third-Party Content

Product data from OpenFoodFacts is licensed under the Open Database License (ODbL). We respect the intellectual property rights of third parties.

8. Disclaimers and Limitation of Liability

8.1 "AS IS" Basis

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Warranty

We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or harmful components. As an open-source project, Services are provided without commercial guarantees.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MIVRO, 1MINDLABS, OR OUR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

9. Indemnification

You agree to indemnify, defend, and hold harmless Mivro, 1MindLabs, and our contributors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any rights of another.

10. Third-Party Services

Our Services integrate with third-party services (Firebase, Google Gemini AI, OpenFoodFacts, Vercel). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or their content.

11. Termination

11.1 By You

You may terminate your account at any time by using the account deletion feature in the app settings.

11.2 By Us

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. We will delete your data as described in our Privacy Policy.

12. Modifications to Services and Terms

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time. We may also update these Terms periodically. Continued use of the Services after changes constitutes acceptance of the modified Terms. We will update the "Last Updated" date to reflect changes.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts located in India.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mivro regarding the Services and supersede all prior agreements and understandings.
